 We ratified the contract 5/9/03

Thank you to the Bargaining Committee for all their hard work and thank you members for your participation.  You ratified the new contract at a 98% yes vote!  We will have the contract printed ASAP and get it out to the members.

 

Synopsis of Agreement

The following is a “synopsis” of the information contained in the “tentative agreements” that have been negotiated between CWA and the San Manuel Casino.

 

 

Article 1 Recognition --  Language change to mirror “Tribal Labor Relations Ordinance” and job titles amended
Article 2 Definitions --  No change.

 

Article 3 Responsible Union-tribal Relationship --  Share cost 50/50 to print contract.

 

Article 4 Tribal Sovereignty --  No change.

 

Article 5 Management Rights –Tribe to make “reasonable effort” to notify Union in advance of changes - M, P & P’s

 

Article 6 Union Security --  No change.

 

Article 7 Union Status  --   No change.

 

Article 8 Dues Checkoff --  No change.

 

Article 9 Seniority -- Some language changed.  Introductory period may be continued 30 days, changed from 120.

 

Article 10 Grievance and Arbitration -- Redefine step I & II procedures.

 

Article 11 Discipline and Discharge --  No change.

 

Article 12 Tribal Gaming Ordinance --  No change.
Article 13 Contracting Work --  No change.

 

Article 14 No Strike/No Lockout --  No Change.
Article 15 Workweek and Overtime --  No Change

 

Article 16 Wages – ADD--- Establish minimum job title start rates.  All bargaining unit employees shall receive no less than the State of California Minimum Wage per hour during the term of this Agreement. Effective June 29, 2003, all employees with one or more years of employment, except “tipped” employees (Food Runner, Lead VPT Service, Lead Wait Staff, Lead Food Runner, Bartenders, Carts, Cocktail Servers, Counter Persons, VPT Services and Wait Staff shall receive a general increase to their base hourly pay rate of 2.5%.

Effective June 29, 2004, all employees, except tipped employees shall receive a 2.5% increase.

Effective June 29, 2005, all employees, except tipped employees shall receive a 2.5% increase.

Employees directed to “train” other employees shall receive an additional $0.50 per hour.

Article 18 Holidays – ADD -- In the third year of the contract employees shall receive an additional eight hours of holiday pay at their regular rate of pay for one floating holiday
Article 19 Sick/Bereavement/Jury Duty – Death of  family member – ADD --  brother(s)-in-law and sister(s)-in-law.  Will grant paid leave of absence for 5 days off.
Article 20 Leaves of Absence – No change.

 

Article 21 Heath and Welfare Benefits.—  The Tribe will pay for health insurance coverage … ADD  -- 50% of the cost of health insurance for an employee plus spouse, employee plus children and /or family.

The Tribe will pay for dental insurance on the following basis:  90% of the cost of dental insurance for an employee & 50% of the cost of dental insurance for an employee plus spouse, employee plus children and /or family.  The Tribe will pay chiropractic & acupuncture coverage for the employee.

The Tribe will pay for Life Insurance for the employee.  The employee may purchase supplemental Life Insurance at their own cost.

Article 22 Training --  No change.

 

Article 23 Health and Safety --  No Change.

 

Article 24 Separability --  No change.

 

Article 25 Credit Union/ COPE --  CWA Credit Union name changed to Building Trades Federal Credit Union
Article 26 Uniforms --  No change.
Article 27 Labor-Management Cooperation --  Delete language that only applied to first contract.

 

Article 28 Other Benefits --  No change.
Article 29 Negotiations and Mergers --  No change.

 

Article 30 Effective Date and Duration of Agreement --  Three-year contract, commencing June 28, 2003  and ending June 27, 2006.
